

These terms apply specifically to social media photoshoots included within ongoing management packages provided by Ree Creative (“Photographer” or “we”). By participating in the photoshoot, the Client (“you”) agrees to the following:
1. Purpose of Shoot
1.1 The photoshoot forms part of the Client’s ongoing social media management package and is not a standalone service.
1.2 Images captured during the shoot will be selected and utilised by Ree Creative exclusively within the agreed social media content package.
1.3 No delivery of a full gallery of images will be provided unless a separate release is purchased (see clause 3).
2. Client Responsibility for Safety
2.1 Where the Client brings their own staff, contractors, clients, models, or any other individuals into the photoshoot, the Client accepts full responsibility for their conduct, safety, and wellbeing
during the session.
2.2 Ree Creative and its team are not liable for injury, loss, or damages incurred by any third parties brought to the shoot by the Client.
3. Image Release Outside of Social Media Package
3.1 If the Client wishes to purchase a gallery of images for use outside of the social media package, a gallery release fee will apply. Please request said fee by messaging your social media
manager following the shoot.
3.2 The release will include approximately 50 edited images selected at the Photographer’s discretion.
3.3 Released images may only be used by the Client for marketing purposes in line with this Agreement.
3.4 If no additional purchase is made the shoot imagery will only be utilised on Instagram in alignment with the purchased service.
4. Client Punctuality
4.1 Clients must arrive on time. If the Client is late, the lost time will be deducted from the session.
4.2 If the Client is late beyond their shoot time, the shoot will be forfeited and the final payment will still be due.
5. Model Release
5.1 The Client and any models selected by the Client grant Ree Creative the irrevocable and unrestricted right to use and publish images from the photoshoot for marketing, advertising,
and promotional purposes.
5.2 If any individuals other than the Client are featured in the images, the Client must obtain their consent for usage and agrees to indemnify the Photographer against any claims related to the usage of the images.
6. Image Editing and Processing
6.1 The Photographer will use professional judgment to select and edit the images/content provided to the Client.
6.2 Any requests for additional editing or special effects beyond the Photographer’s standard practices may incur additional charges.
6.3 Professional retouching (e.g., detailed skin work or removing objects) may incur additional editing fees. Standard editing includes lighting adjustments, cropping, and removal of minor blemishes or stains.
6.4 The Photographer’s style is natural but refined; edits are made to showcase the work at its best.
7. Notification of Issues
7.1 If any technical issues arise during or after the shoot, the Photographer will promptly notify the Client and propose solutions, which may include rescheduling, reshooting, partial refunds,
or alternative compensation, based on circumstances and mutual agreement.
8. Data Loss or Corruption
8.1 The Photographer will take all reasonable precautions to safeguard files during capture, transfer, and storage.
8.2 The Photographer cannot be held liable for unforeseen data loss, file corruption, or storage device failure. In such cases, solutions may include reshooting (if possible) or other remedies by agreement.
9. Liability
9.1 The Photographer shall not be liable for damage, injury, or loss caused to the Client or their property during the photoshoot at Studio Ree.
9.2 The Client is responsible for their own safety and the safety of any individuals they bring (excluding Ree staff) during the shoot.
9.3 If any damage is caused to the studio, equipment or any property at the shoot location by the Client, their staff, contractors or models, the Client will be fully responsible for the cost of repair or replacement. This will be mutually discussed in writing and invoiced accordingly due within 7 business days from the shoot. The client will be notified within 48 hours of the shoot if any damage has occurred.
10. Indemnification
10.1 The Client agrees to indemnify and hold harmless Ree Creative, its employees, and representatives from any claims, liabilities, or expenses arising out of the Client’s participation in the photoshoot or the use of images.
11. Feedback & Dispute Resolution
11.1 The Client agrees to contact Ree promptly with any concerns so they may be resolved effectively.
11.2 In the event of a dispute, the Client must advise Ree in writing of the nature of the dispute, the outcome sought, and proposed actions to resolve the matter.
12. Marketing and Property Rights
12.1 The Photographer reserves the right to use images and videos for marketing purposes including, but not limited to, social media, website, and advertising.
12.2 Projects may be published once finalised unless both parties agree otherwise in writing.
12.3 The Photographer retains intellectual property rights of all creative works and may reuse ideas or designs from cancelled projects.
12.4 Once finalised, the Client will receive commercial rights to use their images for marketing and promotional purposes.
13. Force Majeure
13.1 The Photographer shall not be liable for delays or failure due to circumstances beyond reasonable control (e.g., illness, natural disasters, pandemics, equipment failure).
13.2 In such cases, the session will be rescheduled at a mutually agreed time.
14. Governing Law
14.1 This Agreement shall be governed by and construed in accordance with the laws of NSW, Australia, and both parties submit to the jurisdiction of its courts.
